Please read these Terms and Conditions carefully before using the evedigitalcreatives.com website (the “Service”) operated by Eve Digital Creatives (“us,” “we,” or “our”).

1. General Conditions of Use

• Acceptance of Terms: Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms.

• Modifications: We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will notify users of any material changes.

• Age Restriction: You must be at least 18 years of age to use our services and enter into an agreement with us.

2. Intellectual Property (IP)

• Service Ownership: All content, features, and functionality on the Service (including text, graphics, logos, and software) are and will remain the exclusive property of Eve Digital Creatives and its licensors.

• Client Ownership (Post-Payment): Upon full and final payment for a Website Solution service package, the client is granted full ownership and copyright of the final website design, content, and code developed specifically for them. We retain the right to display the completed website in our portfolio.

• Pre-existing IP: Any proprietary frameworks, tools, or code libraries we use to build the website remain our intellectual property and are licensed to the client for the purpose of running their website.

3. Website Solution Service Terms

• Project Scope: The exact scope, features, deliverables, and timeline for your Affordable Website Solution are defined in the separate Project Agreement or Service Package document provided to you.

• Client Responsibilities: The client agrees to provide necessary content, images, feedback, and approvals in a timely manner to avoid project delays. Delays caused by the client may result in revised timelines or additional fees.

• Warranties and Disclaimers: We warrant that the Website Solution will perform substantially in accordance with the specifications in the Project Agreement for a period of 30 days after launch. We do not warrant that the website will be error-free, nor do we guarantee specific search engine rankings or business results.

4. Billing, Payment, and Refunds

• 4.1 Affordable Pricing: All pricing is outlined in the agreed-upon Service Package. We maintain transparent, budget-friendly payment schedules.

• 4.2 Payment Terms: Payment is due according to the schedule specified in the Project Agreement (e.g., [50%] up front, [50%] upon launch).

• 4.3 Late Payments: We reserve the right to suspend or terminate services, or withhold the transfer of the final website ownership, until all outstanding invoices are paid in full.

• 4.4 Refund Policy: Due to the personalized and labor-intensive nature of our Affordable Website Solutions, all initial deposits and payments are non-refundable once the project kickoff and initial design work have begun.

   

  • Before Work Begins: If the client cancels the contract before our team begins any design, planning, or development work, the deposit will be refunded, less a 10% administration fee.

  • After Work Begins: Once the initial planning or design assets are delivered, no refunds will be issued. We commit resources based on your upfront payment, and this ensures our low prices can be maintained.
  • Termination by Us: If Eve Digital Creatives terminates the project for reasons other than the client’s breach of contract (e.g., non-payment or unreasonable requests), the client will be refunded for any work paid for but not yet completed.

5. Links to Other Websites

Our Service may contain links to third-party websites or services that are not owned or controlled by Eve Digital Creatives. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

6. Termination

• We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

• All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

7. Limitation of Liability

In no event shall Eve Digital Creatives, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of our country, without regard to its conflict of law provisions.
